I was hit by someone who doesn’t have car insurance. What do I do?

Even though it is required by law to carry car insurance while driving, many people drive without any insurance. If you are hit by an uninsured driver, it is still very possible that you can get your car fixed, and get all of your medical bills, lost wages, and pain and suffering paid for.

The chances are that if someone does not spend the money for car insurance, they most likely do not have money to pay you for your damages. Fortunately, there are other ways to recover other than pursuing a claim against the person personally. First, if the person was driving during the course and scope of employment, you will be able to recover payment from the driver’s employer, who is most likely insured or at least has the assets to pay you for your damages.

If the person who hit you was not driving during the course and scope of employment, you can also turn to your own insurance company for payment. If you have collision coverage or uninsured motorist coverage for property damage, your insurance company is supposed to pay to make sure that you get paid for the damages to your car. If you have uninsured motorist coverage for bodily injury, your insurance company is supposed to pay you for your bodily injury claim. Your bodily injury claim includes payment for medical bills, lost wages, and pain and suffering.

Furthermore, if you have Medpay under your policy, your insurance company is supposed to pay you for your medical bills.

It is important to note that just because your insurance company is supposed to do something, it does not mean that they will automatically. Keep in mind that your insurance company is not there to pay you what you think is fair, their job is to pay you as little as possible.
